5.1 Services for our customers as part of the Hermes ProfiPaketService

5.1.1 Your user account

On the Hermes website, you can register for or log in to your myHermes Business user account. You can create your shipping orders with your myHermes Business user account.

You can view your shipment orders with your myHermes Business user account. This function displays information about the progress of the shipment.

You can place one-off or regular collections for your shipment orders using the tool for collection orders. For this purpose, you are requested to provide your collection address in our settings in the myHermes Business user account.

Purposes of processing

We process the data entered by you exclusively for the purpose of making the services of the myHermes Business user account as well as the agreed myHermess Business services available and to provide them to you. Any transmission of the data to third parties is made only to the extent necessary for providing our services.

Type of data

For registration, please provide the following details:

  • Company name
  • Legal form
  • Company address
  • First name
  • Surname
  • Username
  • Password
  • Email address
  • Telephone number

After successful registration, you will receive an individual Hermes customer number.

If you settle the invoices of Hermes Germany GmbH by bank transfer, you can deposit your account details for the processing of credit notes.

This entails the following data:

  • IBAN
  • Deviating account holder,
  • BIC
  • Bank name

If you opt for the direct debit mode of payment, you are requested to provide your account details and your authorisation for the SEPA direct debit:

  • IBAN
  • Deviating account holder
  • BIC
  • Bank name

Legal basis

The legal basis for data processing in connection with the myhermes Business account is Article 6(1)(b) GDPR.

Duration of storage

Your myHermes Business user account remains available to you until you terminate it. If you terminate the account, we will block the data until we no longer need them for the processing and performance of the contract. We will also erase the data when we are no longer required by law to retain them.

Correction option

You can have your data corrected at any time by contacting us in person ( business-sales@hermesworld.com ).

You can also correct your data yourself in your myHermes account at the ‘Edit profile’ menu item.

Possibility of revocation, objection and erasure

If you terminate the account, we will block the data until we no longer need them for the processing and performance of the contract. We will also erase the data when we are no longer required by law to retain them.

Processing of your personal data in third countries

In principle, we commissioned the processing of your personal data in the European Union. Nevertheless, your personal data may be processed in the United States of America (USA). The European Commission has not adopted an adequacy decision for the USA. We have therefore secured the level of data protection with suitable guarantees within the meaning of Article 46 GDPR.

Obligation to provide your personal data

You are not obliged to disclose any personal data. However, if you want to use the above functionalities, it is indispensable to open a customer account.

5.1.2.Storage of data for logging purposes

Processing purposes

Personal data is processed and logged when the online service is used while being logged in. This is done to ensure the security of the portal and to protect user data as well as customer data in the portal. The processing also serves to fulfil the contracts concluded with you and to respond to your enquiries.

Type of data

When you use certain features of our website while logged in, the following (personal) data is collected:

Data about the logged-in user:

  • User name
  • Company name (unless we store transmissions for 3 years)

Data relating to the use of a function:

  • Time of use
  • Type of function
  • Data entered by the user that was necessary to perform the function (e.g. EDL details (what exactly: e.g. neighbour name/ specific drop-off location/ new address/ specific day/ ParcelShop name))

Shipment details when using a function

  • Shipment number
  • Shipment announcement date
  • Recipient address (as long as we do not store shipments for 3 years)
  • Actual delivery location (as long as we do not store shipments for 3 years)

Legal basis

The legal basis in this context is Art. 6 (1) (f) GDPR. Our legitimate interest in data processing lies in the protection of customer and user data. Your interest in confidentiality takes second place. Without the processing of your personal data, it is not possible to use the above-mentioned services.

Duration of storage

The data will be deleted as soon as it is no longer required to fulfil the purpose for which it was collected. The data will be deleted at the earliest after 7 days and at the latest after 3 years.

Possibility of objection and erasure

The collection and processing of data for the aforementioned purposes is absolutely necessary for the operation of the Hermes website. Consequently, there is no possibility for you to object.

Processing of your personal data in third countries

You are not obliged to provide personal data. However, it is not possible to use the above-mentioned services without the above-mentioned personal data.

5.1.3 Create shipping labels

We only require the name and address of the sender and the recipient to create a shipping label. For reasons of data protection, no other personal data will be printed on the completed parcel label.

Optionally, the email address, telephone number and the customer reference of the sender or the recipient can be specified when creating the shipping label for the purpose of receiving an order confirmation, a shipment status report and for contacting in the event of delivery problems.

Please note that the permission of the owner of these personal data is always required when entering the data of third parties.

Legal basis

The legal bases for the collection and processing of data in connection with the creation of the parcel label is section 41a(3) of the Postal Act (PostG) in conjunction with Article 6(1)(b) GDPR and - to the extent that you provide your own or third-party personal data that are not strictly required for the delivery of a shipment (e.g., email addresses) - possibly Article 6(1)(a) GDPR. The legal basis for data processing in connection with the payment transaction is Article 6(1)(b) GDPR.

Duration of storage

We will store the data from the shipping orders in our systems for 12 months.

Obligation to provide your personal data

You are not obliged to disclose any personal data. However, no parcel label can be created without the aforementioned required personal data. All other information is involuntary.

5.1.4 Importing deliveries

With a .csv or .txt file, you can import data into the myHermes Business user account relating to the shipment that are necessary for the shipment (name and address of the recipient, parcel category; bulk goods marking; COD amount; additional information) to prepare a shipping label. Optionally, the email address, telephone number and the customer reference of the sender or the recipient can be specified when creating the shipping label for the purpose of receiving an order confirmation, a shipment status report or for contacting in the event of delivery problems.

5.1.5 eBay import tool

With the eBay import tool, you can import eBay shipping addresses into your myHermes Business account and thus ship items sold on eBay simply with a few clicks. Only the data of the seller and of the recipient that are required for shipping or if provided by eBay (title/salutation, last name/company name, first name, street/street number/address supplement, post code, city, federal state, country, email address, telephone number, status, order quantity, auction number, auction value, auction end, transaction number) will be imported. Importing the data will not cause the data to be erased from the eBay servers. If you wish to erase the data held by eBay, please contact them directly.

5.1.6 Creditworthiness inquiries

Processing purposes

If you are interested in becoming a business customer of our company, we will carry out a creditworthiness check with Schufa Holding AG before concluding the contract.

Type of data

For the creditworthiness we will transmit the following data to Schufa Holding AG:

  • Company name
  • Legal entity
  • Address
  • Date of birth (only for certain legal forms)

Schufa will return the following data to us:

  • Date of inquiry
  • Result of the inquiry
  • Company name
  • Address (street, postal code, city)
  • Person (first name, last name, data of birth)
  • Reason for inquiry

Legal basis

The legal basis for the processing of your personal data is Article 6(1)(f) GDPR. Our legitimate interest is the prevention of future defaults on payment. In this case, our interests take precedence over yours.

Duration of storage

The data will be stored for the duration of the business relationship.

Possibility of revocation, objection and erasure
